Texas PUCT 16 TAC §25.194 Large Load Interconnection Standards (implementing SB 6)
Senate Bill 6 (89th Legislature, 2025) set a framework for large loads in the ERCOT region. The PUCT adopted 16 TAC §25.194 to implement PURA §37.0561, effective 8 October 2026. It applies to large load customers not yet energised that seek a new interconnection of 75 MW or more at a single site, an expansion that reaches 75 MW for the first time, an expansion of 75 MW or more at a site above 75 MW, or co-location with a generation resource. Before being included in an ERCOT interconnection study, a customer must sign an intermediate agreement, make disclosures and post financial security of $50,000 per MW. It must then sign a standard large load interconnection agreement, update disclosures, post security and pay contribution in aid of construction for direct interconnection costs. The rule also sets consequences for withdrawing demand and for false information.
Current status
Adopted at the PUCT open meeting of 18 September 2026 (Project 58317 status filing). Rule text effective 8 October 2026. Other SB 6 rulemakings continue under Project 58317.
Who it applies to
Large load customers in ERCOT not energised as of 8 October 2026: new single-site interconnections of 75 MW or more, qualifying expansions (incremental load only) and co-location with generation.
Exceptions: Applies to the incremental load for expansions. Municipally owned utilities and cooperatives may add their own requirements.
What it means for cooling and power
Speculative ERCOT queue positions now cost real money: $50,000 per MW of security before study, so a 300 MW request needs $15 million posted at the study stage. Disclosure rules also expose duplicate requests across sites.
Editorial: business implications, not legal advice.
